Legal luminary and professor, Stephen Kwaku Asare widely known as Kwaku Azar has subtly questioned the logic of a judgment by Judge Isaac Addo of the Adjabeng Magistrate Court to the effect that firebrand supporter of the governing New Patriotic Party(NPP) who, he found guilty of assault, was too old to go to prison but would go to prison only if she is unable to pay a fine of GH¢10, 400.
“Judge Isaac Addo found Hajia Fati guilty of assault and fined her GH¢10,400 rather than sending her to jail.
The Judge said he decided not to send her to jail because of her age. However, if she fails to pay the fine, she will spend the next 20 months in jail.
This sounds like Hajia is too old to go to jail unless she can’t pay ¢10,400 then she becomes young enough to go to jail.
Ghana anaa!” He wrote on social media sighted by MyNewsGh.com.
The judge, in his ruling, stated that Hajia Fati who was guilty of assault on an Adom FM reporter would not be given a custodial sentence because of her advanced age but instead should pay GH¢10,400.
Then strangely, he added that if she defaulted, she would then serve a prison sentence of 20 months.
This reasoning is what many, including Prof Azar, are wondering how possible it is.
Hajia Fati in 2018 viciously assaulted the Adom FM reporter having mistaken her for an onion seller who had strayed into the NPP headquarters.
In court however, the tough-talking politician pleaded for leniency which ultimately led to her being fined instead of being imprisoned.
